Terms and Conditions of Online Sale (T&C’s)

1. Definitions

Special Conditions: any conditions mentioned in the context of an offer published on the Site in connection with the acquisition of a particular product(s) or service(s) and which supplement or derogate from the T&Cs.

Order Confirmation: the order confirmation that is sent by email to the Customer and/or is available through the Customer's account.

Customer: any person or entity placing an order via the Site.

Calendar days: the days of the week, including weekends and public holidays officially recognised by the cantonal legislation applicable to GIH's headquarters.

Working Days: the days of the week, excluding weekends and public holidays officially recognised by the cantonal legislation applicable to GIH's headquarters.

Customer service: GIH's customer service.

 

Other capitalized terms have the meanings ascribed to them in the Terms of Use.

 

2. Fields of application and modification of the General Conditions of Sale

The General Terms and Conditions govern the contractual relationship - and form an integral part of the contract - between GIH, on the one hand, and the Client, on the other hand. They form an integral part of the Conditions of Use which otherwise apply. In the event of discrepancies between the General Terms and Conditions and the Conditions of Use, the former will prevail.

By placing an order via the Site, the Customer acknowledges having read, understood and accepted, without any reservation, the General Terms and Conditions. In the event of disagreement with the General Terms and Conditions, the Customer shall refrain from placing an order via the Site.

GIH reserves the right to modify the T&Cs, at any time and without notice, by publishing a new version of the T&Cs on the Site (which cancels and replaces the existing version). Any order placed after the publication by GIH of a new version of the General Terms and Conditions constitutes acceptance of this new version.

The Special Conditions are an integral part of the General Terms and Conditions which otherwise apply. In the event of a discrepancy between the Special Conditions and the General Conditions of Sale, the Special Conditions prevail (unless otherwise indicated in the General Conditions of Sale).

 

3. Information mentioned on the Site

Although GIH strives to inform its Customers in the most complete and faithful manner possible, photos, videos and texts illustrating and describing the products or services literally or technically are non-contractual and are provided for information purposes only. They in no way constitute an offer from GIH (which does not guarantee their accuracy) and can in no way be qualified as guarantees or promised qualities. This information does not constitute Special Conditions.

 

4. Registration

The Customer is solely responsible for the accuracy and completeness of the data he provides when registering on the Site. If applicable, the Client must communicate to GIH any modification of the data he has provided, by immediately updating his profile.

The Customer must indicate a valid email address to which all communications relating to the order will be sent. It is up to the Customer to maintain this address in force and to read the emails sent by GIH. The Customer will also take care to configure - and regularly check - his "junk mail" box to ensure that no e-mail from GIH appears there. Any communication made to the Customer by e-mail will be considered as received by the latter on the effective date and time of receipt, but at the latest 24 hours after its sending by GIH.

 

The Customer chooses, when registering, or is assigned, in the event of a reset, a password allowing him to place an order or use other functions of the Site. This password is strictly confidential. It must under no circumstances be disclosed to third parties. The Customer is solely responsible for the use, conservation and security level of his password, which he can modify at any time via the Site. He responds to any order placed, even without his knowledge, using his password. If the Customer knows or suspects that a third party has access to his password, he must notify us immediately.

 

5. Order process

Only Customers who are adults, capable of discernment and who are not under guardianship can place orders via the Site.

 

To place an order, the Customer must follow the procedure available on the Site. Any other ordering procedure is excluded.

 

By placing an order, the Customer binds himself and declares to make a firm and definitive offer to GIH to purchase the selected merchandise or service, as described in the shopping cart at the time of the order, under the conditions indicated. on the Site. Validity of offer may be subject to maximum or minimum quantities. Formally, the Customer submits his offer when his payment is approved. The sale is accepted - and therefore the contract is concluded (under the resolutory conditions provided for in articles 10 to 12) - only from the moment GIH sends the Order Confirmation to the Customer. GIH reserves the right to refuse an offer at its free and complete discretion, without being required to indicate the reasons.

 

The data recorded by GIH constitutes irrefutable proof of orders. The data recorded by the payment system constitutes irrefutable proof of financial transactions

 

6. Price

GIH reserves the right to modify its prices at any time. Only the price indicated in the Order Confirmation is valid.

 

The prices indicated on the Site are expressed in Swiss francs (CHF) and include, where applicable, VAT and the SWICO tax. They do not include any additional taxes that may be required by applicable legislation (e.g. hotel tax for stay offers). Preparation and delivery costs are included.

 

7. Payment

The payment methods accepted by GIH are exclusively those indicated on the Site.

Any order offer is subject to prior payment of the entire amount of the order, as well as preparation and delivery costs. Exceptionally, when the price is high, GIH can accept that only a deposit is paid prior to the order. If GIH refuses the offer, the amount paid by the Customer will be refunded (without interest). If only a deposit has been paid, GIH will inform the Customer of the procedure to follow so that the latter can pay the balance of the price. If, despite an email reminder from GIH, the Customer does not pay the balance, for whatever reason, GIH will be released from its obligation to deliver and the deposit may be retained by GIH as a contractual penalty, this for settlement of all accounts and all claims related to the order concerned.

 

Payments are made using servers made available and secured by GIH's partner financial institutes, so that no financial information concerning the Client passes through our servers.

 

The risk of a malfunction of the payment system is borne by the Customer, at the sole expense of GIH.

 

8. Payment by invoice

When the Customer chooses to pay for the goods or service using the payment by invoice solution, the invoice is payable in 30 days net. The Customer in default may be required to pay a reminder fee of CHF 20.- (per reminder) in the event of non-payment within 30 days.

 

9. Customer’s right of withdrawal

The Customer may revoke his order at any time up to 48 hours before the time reserved.

 

10. Right of revocation of GIH

After the conclusion of the contract, GIH is entitled to cancel an order, not yet delivered, at any time and without having to indicate the reasons to the Customer. When the Terms of Use provide the possibility for GIH to cancel or revoke an order (e.g. in the event of prohibited activities within the meaning of art. 9 of the Terms of Use).

 

11. Consequences of revocation

In the event of revocation, any advance paid by the Customer (excluding preparation and delivery costs) is reimbursed in cash or, at GIH's discretion, by means of a gift voucher. Reimbursement occurs for balance of all accounts and all claims. The Customer will therefore not be able to claim additional damages from GIH, his claims being limited exclusively to the full restitution of the advance paid in cash or in the form of gift vouchers (excluding preparation and delivery costs and without interest). In the event of exercise of GIH's right of revocation (article 10), GIH is released from its obligation to deliver the goods or service.

13. Summary of the T&Cs

For purposes of better understanding, all or part of the T&Cs may be summarized by means of an insert located in the margins of the T&Cs. This summary is not part of the T&Cs which alone are authentic. It is mentioned for popularization purposes only and has no contractual nature. The Customer cannot rely on this

Any reproduction, distribution or other use of the General Conditions of Sale, in modified form or not, is prohibited without obtaining the prior written consent of the author. Unauthorized uses of the General Conditions of Sale will be prosecuted.
